Terms and Conditions of Service

These terms apply to any person or entity (‘you/your’) attending any Alivia Journeys’ retreat, event or experience (‘the Event’) operated under Alivia Journeys brand (‘we/our/us’).

By attending the Event, you agree to be bound by these terms. We may amend these terms and conditions from time to time.

These terms are governed by the laws of Australia.

A. SERVICES

  1. We offer all services listed on the Program Outline.

  2. Your registration and payment of the relevant booking fee does not constitute a booking or guarantee of our services until you receive confirmation of booking from us.

  3. All bookings, even if confirmed, are strictly subject to identity verification either prior to the event via video call and photo identification, or at the commencement of the Event.

  4. We do not make any warranties regarding the benefit, value, quality, or efficacy of any service except as provided by Australian Consumer Law.

  5. We reserve the right to amend the services to be provided at any time.

  6. If we amend the services in a major way before the commencement of the Event, we will provide you with the option to cancel your registration and receive a full refund.

  7. If we amend the services in a major way after the commencement of the Event, we are not liable to provide a refund, offer replacement, or otherwise compensate you for any real or perceived loss of value or benefit if the amendment happens due to the following:

    • weather;

    • Safety concerns;

    • Medical reason;

    • speaker/facilitator cancellation;

    • Third-party default;

    • Any unforeseeable event; or

    • Any other reason not directly caused by our negligence.

  1. If we amend the services provided in a minor way we are not required to disclose, or compensate you for any real or perceived loss of value or benefit from the amendment.

 B. PAYMENTS & REFUNDS

  1. All monies paid are non-refundable. You must notify us of cancellations and changes to bookings in writing and as soon as possible. In the event you are no longer able to attend your Event we will accept you transferring your booking to another person, or other available Event of the same value (or applicable difference paid) if provided with at least 14 days written notice prior to start of the Event. Cancellation later than 14 days prior to the Event will mean that the full cost of the Event is non-refundable and non-transferable. We strongly recommend you take out travel insurance at the time of booking to cover any unforeseen cancellation.

  2. All transfers (name or event) will attract a $100 processing fee.

  3. We maintain wait lists for all sold out Events and where possible will do our best to share your place with those on the waitlist. If we are able to replace your booking then you will be entitled to a full refund minus processing fee of $100.

  4. Nothing in these terms purports to modify or exclude the conditions, warranties, undertakings and legal rights under the Australian Competition and Consumer Act and other local laws. Any and all other warranties or conditions are expressly excluded, including liability for incidental or consequential damages caused by breach of any express or implied warranty or condition.

C. INTELLECTUAL PROPERTY

  1. You may not modify, publish, transmit, participate in the transfer or sale of, create derivative works from, distribute, display, reproduce or perform, or in any way exploit in any format whatsoever any of our intellectual property, in whole or in part, without our prior written consent.

D. DISCLAIMERS

  1. To the extent permitted by law, we have no liability or responsibility to you or any other person for any loss. You acknowledge that you attend the Event at your own risk.

  2. The services and information provided at the Event  may contain general information and discussions about health and related subjects. The information and other content provided at the Event, or in any linked materials, are not intended and should not be construed as medical advice, nor is the information a substitute for any legal, financial, business, information technology or other professional advice. In attending a Event there is no implication of a doctor/patient relationship between participant and the Event provider and all attendees should discuss any health or psychological concerns with their own healthcare provider.

  3. While we make every effort to make sure the information provided at the Event is accurate and informative, the information does not take the place of professional or medical advice. We make every effort to provide quality information at the Event . However, we do not provide any guarantees, and assume no legal liability or responsibility for the accuracy, currency or completeness of the information. The opinions and views expressed at the Event  have no relation to those of any academic, hospital, health practice or other institution.

  4. We hereby expressly disclaim any claims arising from any representations made, whether express or implied, or reliance upon any representations made in relation to our recommendations, or information supplied to you.

  5. Attendees at the Event may participate in extracurricular activities including, but not limited to, swimming and/or other water activities that have not been organised by us and are not part of the Event  program (‘extracurricular activities’). To the extent permitted by law, we do not accept any liability for, and are not responsible for, any damage, loss or injury caused by the participation of attendees in services provided by us or for any extracurricular activities they participate in.

  6. Any testimonials and examples of our products and services, wherever published (online or in print) are not to be taken as a guarantee that you will achieve the same or similar results with our products and services.

  7. Nothing in this disclaimer limits or excludes any liability for personal injury resulting from negligence, or liability otherwise not permitted to be excluded under law.

E. GENERAL

  1. These terms, and any dispute relating to these terms or the Event, are governed by and must be interpreted in accordance with the laws of Australia. Each party submits to the non-exclusive jurisdiction of the courts of Australia in relation to any dispute connected with these terms or the Event .

  2. All waivers must be in writing to be construed as a valid waiver under these terms.

  3. If any part or provision of these terms is or becomes illegal, unenforceable or invalid, that part or provision is deemed to be modified to the extent required to remedy the illegality, unenforceability or invalidity. If a modification is not possible, the part or provision must be treated for all purposes as severed from these terms. The remainder of these terms will be binding on you.

F. COLLECTION AND USE OF PERSONAL INFORMATION

  1. You will need to register to attend our Events. When you register you will be asked to provide us with personal information such as your name, address, phone number, email address and relevant medical information. Whilst we will aim to keep this information confidential and private, we may need to disclose this information to associates or other third parties in order to deliver our services.

  2. We may take photographs or other recordings of the Event and share these on our website or social media. You must advise us prior to attending the Event if you do not consent to this taking place.

  3. We may otherwise collect personal information about you in order to provide our services and for other purposes as permitted under applicable law.

  4. By providing your personal information to us, you consent to the collection, use, storage and disclosure of that information in accordance with these terms.

  5. You are not permitted to take photographs or recordings of any other participants or activities during the Event except with express permission from all participants in the frame or recording.

  6. Whilst we will aim to ensure that no unauthorised photographs or recordings are taking place at our Events, we cannot guarantee, nor accept liability for photographs or recordings obtained by other participants or contractors.

G. SUSPENSION AND TERMINATION

  1. Without prejudice to any other right or remedy available to us, we reserve the right to suspend, terminate or cancel your participation in the Event or any part of it, at any time and without notice:

    • If we consider that you have breached these terms;

    • If you have not provided us with valid photo identification that matches the name on the reservation;

    • If we consider that there is a safety or security concern in relation to you or any other person; or

    • If we consider that it is otherwise appropriate to do so.

  1. If we cancel your reservation in accordance with this clause, we are not liable to provide any refund, replacement, transfer, or other compensation to you whatsoever.

H. CONDUCT RULES

In addition to your obligations set out in these terms, you also agree to abide by the following Conduct Rules:

    1. You agree to co-operate with us in the conduct of the Event and use your best endeavours to comply with reasonable requests made by us to promote the efficient conduct of the Event.

    2. You agree not to cause any nuisance, disruption, or discord during the Event.

    3. You agree to follow the Program Outline and attend all activities in a timely manner in good faith.

    4. You agree to treat us and all participants with courtesy, respect, and civility.

    5. You acknowledge that during the Event you may become the recipient of information of a private and confidential in nature that is shared by us or any other party attending the Event. You agree that you will not disclose to any person any information of a private and confidential nature intentionally or accidentally disclosed during the Event other than information that may reasonably indicate that a party or the public may be at risk of harm or death.

    6. You agree to an identity verification check prior to the Event if requested by us. In addition, you agree to bring photo identification to the Event (passport or driver’s licence). If we identify any discrepancy between the name on registration and name provided on the photo identification, we will cancel your reservation without refund or other compensation and ask you to leave immediately.

    7. You agree that you have or will obtain relevant insurance including car insurance, medical insurance, travel insurance as applicable before attending the Event.

    8. You agree that you will not bring any valuables and if you do, it is your responsibility to safeguard your property.

    9. You agree that you will not attend the event if you are sick with a flu, cold or virus. In cases of illness and a valid medical report, you may transfer your booking to another person without any penalty or transfer fee.

    10. You agree to compensate us for any financial or non-financial loss and damage caused by your negligence, neglect, conduct, act or omission during and after the Event.
